The Petition:

We Demand the Resignation of FBI Director James Comey

On July 5th of 2016, FBI Director James Comey held a press conference to announce whether or not Hillary Clinton should be brought up on charges regarding the mishandling of emails on her private server.

FBI Director Comey acknowledged Clinton sent 110 emails containing "classified" materials, of those, 8 contained "Top Secret" information, and 36 contained "Secret" information. He also said the FBI found additional emails that were not turned over by Clinton which also contained "classified" and "Secret" information.

Comey continued to state the FBI did not find CLEAR evidence that Secretary Clinton intended to violate the laws, but was "extremely careless in (her) handling of very sensitive, highly classified information."

From his statement:

https://www.fbi.gov/news/pressrel/press-releases/statement-by-fbi-director-james-b.-comey-on-the-investigation-of-secretary-hillary-clintons-use-of-a-personal-e-mail-system

"For example, seven e-mail chains concern matters that were classified at the Top Secret/Special Access Program level when they were sent and received. These chains involved Secretary Clinton both sending e-mails about those matters and receiving e-mails from others about the same matters.

There is evidence to support a conclusion that any reasonable person in Secretary Clinton's position, or in the position of those government employees with whom she was corresponding about these matters, should have known that an unclassified system was no place for that conversation. In addition to this highly sensitive information, we also found information that was properly classified as Secret by the U.S. Intelligence Community at the time it was discussed on e-mail."

Comey also acknowledges that foreign, hostile actors possibly accessed Clinton's emails, including the classified materials.

From the statement:

"We do assess that hostile actors gained access to the private commercial e-mail accounts of people with whom Secretary Clinton was in regular contact from her personal account. We also assess that Secretary Clinton's use of a personal e-mail domain was both known by a large number of people and readily apparent. She also used her personal e-mail extensively while outside the United States, including sending and receiving work-related e-mails in the territory of sophisticated adversaries. Given that combination of factors, we assess it is possible that hostile actors gained access to Secretary Clinton's personal e-mail account.."

In light of the investigations and evidence, the FBI is still declining to levy charges against Clinton.

From the statement:

"Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case. Prosecutors necessarily weigh a number of factors before bringing charges. There are obvious considerations, like the strength of the evidence, especially regarding intent. Responsible decisions also consider the context of a person's actions, and how similar situations have been handled in the past."

It is not the responsibility of Director Comey to decide whether or not a prosecutor will or will not attempt prosecution. The FBI's job was to investigate and present evidence which supports or denies potential charges against Clinton. Comey acknowledges Clinton performed wrongdoing, and that classified materials potentially ended up in the hands of hostile agents (governments.) Comey states that any high ranking official should have known better. Yet, under his direction, no recommendation for charges will be filed.

This is a blatant disregard of the rule of law, and sends a clear message to the people that certain members of society are exempt from prosecution for their deliberate and damaging actions.

Due to the FBI Director's clear disregard for the rule of law and justice in this country, We The People demand his immediate resignation. Also, We demand a probe to investigate any wrongdoing on the part of the FBI, to determine if there were any conflicts of interest between the FBI, the Clintons, and Attorney General Loretta Lynch.

Signed,
The Citizens of the United States.
